Reposting other artist work on social media.
298I'm wondering what people thoughts are on this.
The reason I ask is that Renderhub has just posted my image The Littlest Jester on their Facebook page without asking permission first. While on the one hand I appreciate the exposure ( there's a link to my gallery here) there is a huge amount of ambiguity about who owns the copyright of an image once its posted on Facebook - or any social media for that matter. That's why I never post any of my work on any social media platforms.
With the exception of a few older images in the Daz gallery I only post my work here. Which makes me ask: who owns the copyright to an image when it is posted in the gallery here?
I don't want to come across as a prissy artist having a tantrum.

The short answer is you retain the copyrights but when you posted the content you explicitly gave them the right distribute it, and specifically to third-party websites or advertising medium. That would be Facebook.
This is the section about copyright
5. YOUR CONTENT
Content that you upload, post or otherwise submit and make available using our Services is your content ("Your Content"). You retain any copyright that you have in Your Content.
This is the pertinent section of the TOS about distribution (my bolding and underlying of the line)
5.3 Permission to Use Your Content. By posting Your Content, you grant RenderHub a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content. This allows us to provide the Services and to promote RenderHub, your RenderHub store, or the Services in general, in any formats and through any channels, including across any RenderHub Services, our partners,or third-party website or advertising medium. You agree not to assert any moral rights or rights of publicity against us for using Your Content. You also recognize our legitimate interest in using it, in accordance with the scope of this license, to the extent Your Content contains any personal information.

Tue, Jun 23Thank you for the response. So I retain the copy right of images I post to my gallery. That's good to hear.
Does Renderhub, by recognising the copyright of the artist, have a responsibility to ensure that any art posted to another site also recognises the artist copyright?

Tue, Jun 23I'm just another member here, so I don't have an official answer to that one. I suspect though that Renderhub would not post anything to a website that didn't recognize their copyrights so they wouldn't post our work there either.
That said if you post anything anywhere on the Internet there is always the chance some clown is going to copy it, modify it to put his logo on it, and claim it is his. It's also pretty much going to be used for AI training unless you format the file in a way that screws that up.
But that's been going on for at least as long as the Internet, probably longer.

Wed, Jun 24If you're unfamiliar with copyright and licensing, here's a decent starting-off point: https://www.copyrighted.com/blog/licensing-vs-copyright
Yes, you retain copyright ownership of your work. However, by using and posting to RH, you grant the business a whole slew of freedoms (i.e. license) over that copyrighted work and how they can use it. So it's at least good to understand what that entails to avoid getting caught by surprise. I *think* most of it is innocuous, and just covering their butts. It'd be tedious and time consuming if they had to stop and ask for permission every time they wanted to collage a bunch of our entries/images together to promote one of their contests. Or worse, if they had to go and retract them all over the Interwebs because someone got mad and decided they couldn't use their images any more.
However, since I'm not a lawyer, I'm not sure if it also means they can slap our renders on printables, cut them up, and sell them as bookmarks for a buck each at the local Dragon Con. Awareness is your friend. As is being selective about what you post (any where; see diogenese19348's post above), but especially things you want to retain rights and control licensing to. For example, if you were putting together an annual pinup or fireman's calendar to sell or planning to publish a coffee table book of your Best of Moogee, it's better not to post those images collectively or individually until you've consulted a professional who can shed light on how best to safeguard your work.

Thu, Jun 25Thank you for you reply and the link. I'll look into that. I've only been posting my work on line since I joined Renderhub so there's a lot of copyright stuff, etc that i need to catch up on.

As you may have noticed on our social channels, RenderHub makes a strong effort to promote the work of our community members. As @diogenese19348 pointed out, our Terms of Use allow us to feature members' work in this way. And importantly, artists retain ownership of their content.
With that said, if any community member is uncomfortable with their work being featured in a social media post, we will happily remove it if possible. Just send a message to Support with a link, and we'll take care of it. No problem at all.
Thank you for being a valuable member of RenderHub. We appreciate your contributions to the community.
